Key issues: Car loan | credit provider | responsible lending obligations | misconduct of a credit assistance provider 


Case summary

 

The FSP has not breached its responsible lending obligations.  We considered that the car loan was not unsuitable for the consumer, and the FSP made reasonable inquiries about the consumer’s financial situation. 

 

The FSP was not responsible for the alleged inappropriate conduct of the credit assistance provider.  We considered that the broker acted as an agent for the consumer and not the FSP
