Case summary










We find that:


  • the consumer’s claim that the FSP engaged in misleading or deceptive conduct has not been established, 


  • the FSP breached its responsible lending obligations and, after completing our own serviceability assessment, we find that the consumer could not afford her financial obligations under the lease contract, and


  • the consumer’s claim that the FSP breached the consumer guarantees has not been established.
