Key issues: Broker | Loss suffered by consumers The relevant questions in the present case are:
- whether the loss suffered by the complainants is of a type for which I can award compensation under the COSL Rules
- whether the loss can be attributed to an act or omission of the member
- whether the loss was reasonably foreseeable, and
- whether the complainants contributed to the loss or had the opportunity to avoid their loss but did not do so.
