Determination - 30 August 2016

Key issues:

Credit Card/Judgment debt | Debt purchaser | Stay on execution of judgment | Financial hardship assistance | Inappropriate third party contact

Summary of the complaint:

It is not appropriate to provide a further stay on execution of any of the judgment debts, nor is the FSP required to provide the consumer with financial hardship assistance at this time.  We determined that the FSP should ensure that the consumer’s current address is used for future correspondence.

This Determination affirms the position set out in our Review dated 29 March 2016.
