Key Issues: Credit card | Lender | Failed to comply with obligations under the ePayments Code | Unauthorised transactions

Case summary

  • The consumer’s credit card was fraudulently used by a third party for unauthorised transactions.
  • The consumer reported the unauthorised transactions to the FSP and requested they be refunded to her credit card.
  • The FSP said it was not liable for the unauthorised transactions.
  • We found that the consumer’s claim was established and that, under the ePayments Code, the FSP was liable to refund the unauthorised transactions back to the consumer.
